Smartara is an agency operated by Muhammed John, trading as Smartara, based between Morocco and The Gambia. Smartara is not yet a registered company — until it is, any agreement, invoice, or contract is between you and Muhammed John personally, trading as Smartara.
What these terms cover
These terms govern your use of smartara.co and the general basis on which Smartara provides services (AI automation, data, web, and marketing work, as described on this site). The specific scope, price, and deliverables for any project are set out in a separate proposal or contractor agreement signed with the client — that document controls where it differs from this page.
Payments
Invoices are issued through Smartara HQ, our internal client system, and may be paid by bank transfer or by card. Card payments are processed by one of two providers depending on currency:
USD and MAD payments are processed by Paddle.com Market Ltd, who act as the Merchant of Record — meaning Paddle is the seller of record for the transaction, handles the charge, and issues the receipt. GMD payments are processed by Modem Pay, a Gambia-licensed payment aggregator. Smartara never receives or stores your full card details.
Deliverables and intellectual property
Unless a signed agreement says otherwise, ownership of project deliverables (code, designs, content) transfers to the client once the relevant invoice is paid in full. Smartara may retain the right to display completed work as a portfolio example unless the client requests otherwise in writing.
Acceptable use
You agree not to use smartara.co to attempt unauthorized access to any system, to submit false or malicious information through any form on this site, or to use the site in a way that could disable, damage, or impair it.
Liability
Services are provided on a professional best-effort basis. To the extent permitted by law, Smartara's liability for any claim arising from a project is limited to the fees paid for that specific project. Nothing here excludes liability that cannot be excluded by law.
Changes
These terms may be updated from time to time; the version on this page is the current one. Material changes affecting an active project will be communicated directly.
